Does the HIPAA Act protect Prescription Records?

I had been without health insurance for a few months. I applied for some Humana coverage, as an independent. Over the course of the underwriter interview, the underwriter asked me if I had anything to disclose. I said no, and then she began to recite a list of all prescriptions that I'd gotten for the past 4 years! I was pretty shocked, because I thought that information was considered private. How did Humana (or anyone for that matter) get such quick complete access to my prescription records?

  1. Regardless of the HIPAA laws medical laws insurance companies share this info all the time. Nothing is private anymore. Basically the HIPAA laws state that the average Joe off the street can't have access to your medical records.
