In December of 2010 I had to go to court because my ex request that I pay child support of our 9 year old son. I asked that I not pay child support since I had him at least half the time, every week Fri-Monday morning +, and it was ruled that I did not have to pay him support. I was asked however if I thought it was fair to reimburse him for insurance ( he was very smart and after the break up rushed to add him to his insurance before i could) and I said yes. The court ordered that I pay $X amount a month and that was that. He was the given main custody of our child. I didnt argue, which I now regret, because since I left I wanted my kids (one older son, a year older that he helped me raise too) to attend the same school for the remainder of the year and not separate them since they are very close. In about April or May my ex got fired for stealing time from the company and he lost his medical insurance but I have still been paying him since. He did not inform me he got fired, i had to find out on my own. I am about to request a review/modification from the Texas Attorney General. I wanted to request that A) I be allowed to stop paying him medical reimbursement for insurance that he is no longer provided. and B) That I be awarded custody of our son since I feel that him getting fired over stealing and still not having a job (to my knowledge though if he did he refuses to give me such information) shows he is irresponsible. He says that he is putting him on CHIP but being that he will probably get that for free is that even allowed? For me to pay him for medical reimbursement when he receives it from the government for close to free if not free? Do you think that they can give me primary custody of my son? Side note: I've had my kids Friday- Monday morning while they were in school, during their spring break when he decided to go on vaca with his new girl, and Since June 9th and will have them all until they go back to school in August. My kids visited him fathers day and a few hours the Fourth of July. I told him that my older son will live with me from now on and now he refused to help with anything financial (which is fine) and even has gone as far as to say that he should be reimbursed for the last 11 years for helping support him. He has his Social Security and I think he is claiming government benefits with it and (this is not his biological son) and says he is going to claim both children for income tax. I've asked him repeatedly to give me back my son's social card and he refuses. If things continue the way they have I will have had them both for over half the year, Can I request that I be allowed to claim them since he has hardly supported them at all. I have had my kids for over a month and I'm reimbursing him for something he is not providing. That takes food and clothes and what not away from my kids.
