mother and father has health insurance for baby in california?

mother and father has health insurance for baby in california? if the baby goes into the hospital how can the mother be primary if she is younger then the father? if the fathers birthday is before the mother? in CA they have the birthday law of whom ever is older that persons insurance is primary. is there a way to by pass it and have the mothers insurance kick in as primary?
