can my employer change my health care plan without my consent?
I live and work in new york city. i went to pharmacy to refill my prescription and was told my insurance doesn't cover advair and arbutiol anymore and i would have to pay out of pocket for my medicine ($288.00) I emailed the agent at oxford and she told me i'm under a different plan and that plan doesn't pay for my medicines and that i had to find alternative medications! Of course i was floored. so is it legal to change medical coverage without employee consent?

- This has happened to me before. Ended up paying over $1,000 for chiropractic treatment. Insurance companies aren't supposed to do this, but there are loopholes in the legal system and when they find them they can change your coverage without your consent.
- Do you have a guarantee for one insurance? Then keep working your non union job and getting legally shoved around by your employers. I would think, but don't know legally, that you should have been informed and then received new cards from the new insurance as well as some type of booklet that explains your coverage. Can they do it? Looks like it. I now live in a right to work state and moved here from a union job. Insurance is so important and with a union, benefits are bartered for with each contract and as such, you know what to expect. Employers are legally bound to each contract. But without a guarantee, I think they can pretty much do what they want.
- it prob wasnt your employer. My insurance plan was changed as well but it was my insurance company...they changed he name of the plan and the coverage the other plan ceased to exist...not sure you should ask your employer if it was them if not then it was the insurance comp
- unfortunately it is legal and it is done all of the time. I used to be covered for nexium but then about 3 years ago it was no longer a covered drug. for about 1 year my doctor was able to force the insurance company to cover it but after that NO COVERAGE. I now buy it online from Europe from a site called Low-Cost-Rx.com because it is the only reflux med that works. so much for the governments medical plans happening anytime soon
- Absolutely. Employers do it all the time. Health insurance is not a right in the US. It's a benefit offered by some employers. It can be changed or eliminated at any time.
