Florida Health Insurance Question?
A friend of mine has Blue Cross Blue Shield through his employer in Florida. His premium is a whopping $600.00 a month. He wanted to lower his premium and his employer says he can't change his insurance plan. He wanted to cancel his insurance and his boss says he can't, unless he fires him. I told him it sounded as though his boss is ripping him off. He contacted Blue Cross Blue Shield and they told him his boss has the right to charge ANY amount he wishes. They would give him no information about his premiums and referred him back to his employer. My friend doesn't even remember if he ever got his paper policy. All the links to write the insurance commissioner has not worked. Can anyone tell me out there if it isn't true that it is anyone's civil right to cancel an insurance policy and what my friend might do next?

- If he has insurance through his boss, it's not HIS policy, it's his BOSSES policy, and he doesn't GET a paper policy. The IRS says, that employees can ONLY cancel their participation in group health insurance plans, during open enrollment. So, if he doesn't die, or quit his job, his boss is right - he CANNOT drop out of the plan. And it's not his boss ripping him off - it's the IRS ripping him off. These are TAX laws, that keep him from quitting his plan. Yes, it's the IRS violating his civil rights. Good luck going up against THEM!!
- You have no right, civil or otherwise, to cancel insurance that you receive through work while you are still employed. In most cases, the tax laws do not allow them to let you cancel. It is not your decision and it is not their decision. With a very few exceptions, they are prohibited by law from letting you cancel. (An example of one of the exceptional cases in which they can let you cancel is if you get married and obtain coverage from your spouse's employer.) However, if he really wants to stop paying for this coverage, he can quit the job. He does not have to be fired.
