Can i loose health insurance?? for a workman's comp claim?

I had a back injury in 2005 , was operated on and recovered ok. worked a almost 2 years and re injured same area in my back. Now i have the insurance company from the first injury fighting with the current insurance company about which one is responsible for time loss and medical bills. I talked with my employer about what was going on and they agreed with me that i should not do this position anymore but could not legally move me to another position until the legal stuff was over and i had a certain % of disability( i think 5%) they recommended I sign a "leave of absence" while all this goes on ,which i have done. this was because since the 2 companies are fighting over who is responsible, i am legally "not on workmans comp and have to work" so the leave of absence was basically to keep my job. Unfortunately this resulted in my being dropped from my insurance through my employer and having to COBRA my insurance. (1000 $ a month) .....yes i have a lawyer (he says he doesnt know about the leave of absence / health insurance issue ), he does workmans comp only...any ideas????

  1. Apply for state Medicaid immediately. When it asks if you are receiving workers comp, check no, since you aren't. Don't even try explaining it to them. They won't hear it. Just avoid the hassle and get some health coverage while all of this gets sorted out. And never sign anything that gives anything away without talking to a lawyer first. Contact your state's labor board. See what they can do for you.
  2. (1) get a lawyer with a clue (2) you can lose health benefits if you're not drawing a paycheck, you pointed out that you can get cobra but the cost is very high (3) stay at work if at all possible.
