BCBS of Florida, Health Insurance at work, Expert Needed !?

2 times now, BCBS of Florida has conspired with my employer to cut my benefits. I have an on-going cancer claim. Sooner or later, if they keep "cutting benefits" I'll be with no benefits. My claim is still active, since 2007. They have done this twice with no notification to me. This costs me more out of my pocket on the co insurance and deductibles. I do not think by law, they can cut my benefits this way. Help !

  1. First of all, how are they cutting your benefits? Are they changing just your benefits or are they changing the plan all together? Do you have a patient care manager? When does your plan year begin? Everything will restart each plan year, so you'll have to do deductibles, etc, all over again, and if they change the plan for all employees, that's within their right.
  2. If your employer is changing the benefit plan for all employees, then they would be required to make those same changes for you. Many employers are raising deductibles and coinsurance for employee benefit plans as a way to keep plans going despite rising premiums. Since this is a group health plan through an employer, they would need to make the same changes to everyone. If that's what's happening, then its legal and there's nothing you can do about it. An employer isn't obligated to offer health insurance at all. They are certainly free to make changes to the plan they voluntarily choose to offer as a benefit. Or even cancel the health insurance entirely. (Exception being, of course, if there were a union contract in place to offer a specific set of benefits at a certain deductible/coinsurance level.) If you were being singled out and changes were only being made to your deductible/coinsurance, that would be in violation of the law. A group plan has to be equal for all employees of the same classification who elect the same plan type. I suspect in this case that your employer is simply altering the entire group's plan. You can certainly verify that if you wish, for your own peace of mind. Good luck!
  3. It's quite common as others have said for a company to lower their benefits to lower their costs. It likely has nothing directly to do with you or your claims, but if the company is getting hit with rate increases (which they would be hit with wihtout your claimes) they're going to look to cut costs. So long as everyones' benefits are changing they are not breaking any laws. Sorry this happened to you, but good luck.
