Can I still get money for medical costs of an injury that just now showed up?
I was in a wreck late Nov. 07, and now, in mid-Jan 08, I am experiencing what I believe to be a PCL tear (dashboard injury). Can I still report this to the lady who was responsible for the wreck's insurance company? I'm like 95% sure that this is from the wreck, since I have not played major sports, and this is usually only caused by wrecks and stuff. I want to get this checked out, but I want HER insurance company to pay for it! Can I still make them? We still haven't settle on any amount of money yet... so I would think yes.. but you never know these days!!!!

- That is a significant delay in treatment and would likely be questioned, if not denied. Also regardless of the delay they will not pay for it up front. That is not how injury claims work. They only pay upon settlement of claim. Lastly depending on your state laws you may or may not have a claim. I would check with your insurance company on how to proceed.
- Nature of injury and the time frame seem reasonable to me. You may, however, need to hire an attorney as you can rest assured they'll fight this. What kind of medical do YOU have as your company should be paying something on your med bills now as well--seems if you could get some testing/diagnosis that should make for a stronger case. They may also be willing to give you some tips on getting her company to do right by you. They won't pay for that or anything else until you do settle, so the key is to get the needed medical done ASAP without someone breathing down your neck for payment. Then when you know the true amount of bills and extent of injury you have a way to tell a reasonable offer. If you can avoid an attorney that's good as they cost you at least 25% of the settlement, but you may need one as too many companies don't want to pay legit claims. Good luck.
- hmmm....well..... The first order of business is to take care of yourself. Everyone has a duty to mitigate their damages - whether they are vehicular or physical. Don't let yourself get worse because you don't know who is going to pay. Now - How do you know you have a "PCL?!" tear. Has it been diagnosed by MRI? Who is treating you? Did they give you a cause? Did they know you were in an auto accident? Did the DOCTOR relate it to the accident? Most injuries are acute - in this case that means they happen when the accident happens..........they don't 'manifest' over time. As an adjuster - a manifested injury (something you just now discovered) raises red flags. If you had pain in that area after the accident - hopefully you reported it to....someone. You will only have a cause against the other person/their insurance company if your injury is related to your accident and documented/confirmed as such. The statute of limitations for a November 2007 accident will not have expired yet so you can still make a claim.
